Terms of Service

These Terms of Service (hereinafter the "Terms" or "ToS") govern access to and use of the website meilleursjobs.com, together with all of the features, services and applications offered through it (hereinafter collectively the "Platform" or the "Service"), published by MEILLEURSJOBS, a French simplified joint-stock company (SAS) with share capital of EUR 10,000, registered with the Montpellier Trade and Companies Register (RCS) under number 941 599 466, whose registered office is located at 1 Place Pierre Mendès France, 34170 Castelnau-le-Lez, France (hereinafter "MeilleursJobs" or "we").

By accessing the Platform and/or creating an account, the user (hereinafter the "User" or "you") acknowledges that they have read and unreservedly accept these Terms. If you do not accept these Terms, you must immediately stop using the Service.

These Terms govern the use of the Platform. The financial and commercial conditions applicable to paid services (in particular CVBoost and Candiboost) are set out in separate Sales Terms, which apply in addition to these Terms whenever a paid subscription is taken out.

1. Definitions

  • "Platform": the website accessible at meilleursjobs.com, together with all of its subdomains, applications, APIs and related services.
  • "User": any natural person who has reached the age of majority and who accesses the Platform, whether or not they have an Account.
  • "Account": the personal, secure space created by the User, allowing them to access the features of the Service.
  • "User Content": any data, information, file, text, image, CV, cover letter, professional profile, third-party service credentials, or any other element transmitted or uploaded by the User to the Platform.
  • "CVBoost": the Platform module that enables the creation, optimisation and formatting of curriculum vitae, supported by artificial intelligence.
  • "Candiboost": the Platform module that enables the automated sending of personalised spontaneous applications to employers targeted by the User, on the basis of the parameters set by the User.
  • "Paid Services": all paid subscriptions and paid options offered on the Platform, the terms of which are described in the Sales Terms.

2. Purpose

The purpose of these Terms is to define the conditions for accessing and using the Platform, as well as the respective rights and obligations of MeilleursJobs and the User.

The Platform is designed to support candidates in their job search, in particular through tools that assist with drafting curriculum vitae, sending spontaneous applications, analysing job descriptions and conducting professional outreach with the help of artificial intelligence.

MeilleursJobs is neither a placement agency, nor a recruitment firm, nor a placement provider within the meaning of Articles L.5321-1 et seq. of the French Labour Code (Code du travail). MeilleursJobs makes no guarantee whatsoever as to obtaining a job, an interview or a response from contacted employers. The Platform is a tool made available to the User, the results of which depend on the User's own profile, situation and actions.

3. Access to the Platform

3.1 Conditions of access

Access to the Platform is open to any natural person who has reached the age of majority (18 years of age or older) and who has the legal capacity to enter into contracts within the meaning of the French Civil Code (Code civil). Registration by a minor is prohibited. The creation of an Account by a minor, even with the authorisation of their legal representative, is not allowed by MeilleursJobs and will result in immediate deletion of the relevant Account.

Access is strictly reserved for personal, non-commercial use. Use of the Platform by an employer, recruitment firm, temporary employment agency, aggregator, reseller or any other third party for the purposes of prospecting, scraping, collecting candidate data or reselling such data is expressly prohibited and constitutes a substantial breach of these Terms.

3.2 Account creation

Use of the Platform requires the creation of an Account. The User undertakes to provide accurate, complete and up-to-date information when registering and to keep that information up to date for the entire duration of use of the Service. The User warrants that the information provided concerns them personally and that they are not creating an Account on behalf of a third party.

The User is solely responsible for the confidentiality of their login credentials (email address, password, active sessions). Any action carried out from the User's Account is deemed to have been carried out by the User. In the event of fraudulent use of their Account, the User undertakes to notify MeilleursJobs immediately at support@meilleursjobs.com.

3.3 Availability of the Service

MeilleursJobs will use reasonable efforts to keep the Platform available 24 hours a day, 7 days a week. However, MeilleursJobs is subject to a duty of best efforts only and cannot guarantee uninterrupted or error-free availability. Access to the Platform may be suspended, restricted or interrupted, in particular for maintenance, updates, security reasons, force majeure events, or any other technical or operational reason. Where possible, MeilleursJobs will inform Users of scheduled interruptions.

4. Description of features

4.1 Free features

Some Platform features, identified as such, are accessible without a paid subscription, subject to creating an Account.

4.2 Paid features — CVBoost and Candiboost

The CVBoost and Candiboost modules, together with any other service identified as paid, are accessible through a subscription taken out by the User. The pricing terms, trial conditions, duration, tacit renewal, right of withdrawal and cancellation conditions are exhaustively described in the Sales Terms.

4.3 Sharing data with MeilleursJobs Partners — essential clause of the contract

MeilleursJobs's business model is based, in addition to paid subscriptions, on connecting Users with partners operating in the employment, training and human resources sectors (hereinafter the "Partners"). On that basis, and in consideration for the free or reduced-price provision of part of the Service, the User expressly acknowledges and accepts, as an essential and decisive condition of the contract entered into with MeilleursJobs, that:

  • their identification data, professional profile (career history, training, skills, expectations, location, target sector, situation, availability) and preferences will be shared with Partners selected by MeilleursJobs, exclusively for purposes related to employment, training, recruitment and related HR services;
  • the recipient Partners will be able to contact them directly, in particular by email, to send them job offers, training offers, mission proposals or any other service related to their job search and professional development;
  • this sharing constitutes an inseparable element of the service contract entered into with MeilleursJobs.

The categories of Partners and the precise details of these processing operations (purposes, recipients, retention periods, applicable rights) are detailed in the Privacy Policy.

The User retains, at all times, the right:

  • to object to specific solicitations by using the unsubscribe links provided in each communication or by contacting the relevant Partner directly;
  • to stop using the Service and to delete their Account in accordance with the conditions set out in Article 11.1, which will put an end to future sharing.

Acceptance of these Terms entails acceptance of the data-sharing clause described above.

4.4 Validation of commitments upon subscription

Acceptance of the data-sharing clause described in Article 4.3 is collected from the User upon Account creation, by ticking a dedicated box within the registration form. Acceptance of these Terms, together with the Sales Terms in the event of a paid subscription, is collected upon final validation of the registration or payment form, in accordance with Article 5.1 of the Sales Terms for Paid Services.

For evidentiary purposes, MeilleursJobs retains the technical elements that make it possible to demonstrate the conclusion of the contract and acceptance of the provisions that make it up (timestamp of registration and order, IP address, version of the documents in force).

4.5 Use of artificial intelligence

The Platform integrates artificial intelligence models (in particular large language models, or "LLMs"), provided by third-party suppliers, in order to generate or suggest content (CVs, cover letters, application messages, etc.).

The User is expressly informed that:

  • content generated by artificial intelligence may contain errors, inaccuracies, omissions or inappropriate phrasing;
  • it is the User's sole responsibility to review, validate, correct and adapt any generated content before using or sending it;
  • MeilleursJobs cannot be held liable for the content of applications sent by the User or for the consequences arising from inaccuracies in or the substance of generated messages;
  • no data transmitted through the AI features is used to train general-purpose artificial intelligence models (see the Privacy Policy).

4.6 Spontaneous applications (Candiboost) — User responsibility

The Candiboost module enables the User to send, from their own email address or via the technical means made available by MeilleursJobs, spontaneous applications to recipients that they select or validate.

The User acts as the sender of these applications. They assume full editorial and legal responsibility for them. In that capacity, the User undertakes to:

  • not send messages that are insulting, defamatory, misleading, deceitful, harassing or contrary to applicable laws and regulations;
  • comply with the sending frequency and technical limits set by MeilleursJobs and by third-party services (Gmail, SMTP providers) in order to preserve deliverability;
  • promptly handle any unsubscribe or objection request from a recipient;
  • not use the module for spam, unsolicited commercial prospecting within the meaning of Article L.34-5 of the French Postal and Electronic Communications Code (Code des postes et des communications électroniques), or any other purpose unrelated to a personal job search.

MeilleursJobs acts as a technical hosting provider within the meaning of Article 6 of the LCEN (French Act for Confidence in the Digital Economy) with respect to content drafted or validated by the User and sent via the Candiboost module.

5. Obligations and undertakings of the User

The User undertakes to use the Platform in good faith, in accordance with these Terms, the Sales Terms applicable to paid services and applicable law.

In particular, the User shall not:

  • use the Platform for unlawful, fraudulent or misleading purposes, or in a manner that infringes the rights of third parties;
  • transmit, upload or distribute via the Platform any content that is unlawful, insulting, defamatory, racist, xenophobic, sexist, homophobic, inciting violence, hatred or discrimination, or contrary to public order and morality;
  • impersonate a third party, use a false identity or provide inaccurate information;
  • impair the operation of the Platform, its security or its integrity, in particular by introducing viruses, malware, or by any attempt at unauthorised intrusion;
  • extract, scrape, harvest, copy, reproduce or reuse all or part of the Platform's content for purposes other than strictly personal use, or use any automated tool (robot, bot, crawler) without prior written authorisation;
  • resell, sublicense, share or make available to a third party access to their Account or to the services subscribed;
  • use the Platform's content, templates, distinctive signs or databases in violation of the intellectual property rights of MeilleursJobs or of third parties;
  • carry out "reverse engineering" of, decompile or disassemble the Platform.

Any breach of these obligations may result, at MeilleursJobs's sole discretion, in immediate suspension of the Account, termination of ongoing subscriptions without refund, and, where applicable, civil or criminal proceedings.

6. User Content — ownership and licence

6.1 Ownership

The User retains all of the intellectual property rights they hold in the User Content that they transmit to the Platform.

6.2 Licence granted to MeilleursJobs

The User grants MeilleursJobs a free, non-exclusive, worldwide licence to use the User Content for the duration of use of the Service, strictly limited to the following purposes:

  • providing, operating, maintaining and improving the Platform;
  • generating, through automated processing, the content requested by the User (CVs, cover letters, applications, etc.);
  • ensuring the proper technical operation of the necessary third-party services (hosting, email sending, artificial intelligence, payment);
  • producing anonymised statistical analyses for the purpose of improving the Service.

This licence excludes any advertising or commercial use of the User Content, any resale to third parties, and any training of general-purpose or foundation artificial intelligence models.

6.3 User warranties

The User warrants that they hold all of the rights and authorisations necessary in respect of the User Content, that such content does not infringe any third-party rights, and that they have the right to grant the licence referred to in Article 6.2. The User indemnifies MeilleursJobs against any action, claim or recourse from a third party based on the User Content.

7. MeilleursJobs intellectual property

All the elements making up the Platform — architecture, source code, interfaces, databases, trademarks, logos, names, CV templates, templates, prompts, datasets, editorial content, illustrations, graphic charter — are the exclusive property of MeilleursJobs or of third parties that have granted a licence. These elements are protected by the provisions of the French Intellectual Property Code (Code de la propriété intellectuelle).

Subject to compliance with these Terms, MeilleursJobs grants the User a personal, non-exclusive, non-transferable and revocable right to use the Platform, solely for the duration of use of the Service. No other right, in particular of reproduction, representation or adaptation, is granted to the User.

8. Personal data

The processing of Users' personal data is described in the Privacy Policy, which forms an integral part of these Terms.

The User has, at all times, the rights provided for by Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act (loi Informatique et Libertés) as amended, the procedures for exercising which are specified in that Policy.

9. Liability

9.1 Liability of MeilleursJobs

MeilleursJobs undertakes to provide the Service with due care and in accordance with industry best practice, on a best-efforts basis.

MeilleursJobs cannot be held liable for:

  • indirect damage suffered by the User (loss of opportunity to obtain a job, loss of income, loss of opportunity, damage to image, etc.);
  • the use that the User makes of content generated by the Platform, in particular through the artificial intelligence features;
  • applications sent by the User via the Candiboost module, over which the User retains editorial control and effective sending;
  • the decisions, responses or absence of response of contacted employers or recipients;
  • malfunctions attributable to the User, their equipment, their internet connection, or third-party services (Gmail, telecommunications operators, banks, etc.);
  • force majeure events as defined by French case law.

To the fullest extent permitted by law, and without prejudice to mandatory provisions applicable to consumers, the total cumulative liability of MeilleursJobs towards a User who has taken out a paid subscription may not exceed the total amount actually paid by that User to MeilleursJobs during the twelve (12) months preceding the event giving rise to liability.

9.2 Liability of the User

The User is solely responsible for:

  • the accuracy, completeness and lawfulness of the information they provide to the Platform and transmit to third parties;
  • the content of the applications, messages, CVs, cover letters and other communications they send via the Platform or by using the features of the Service;
  • compliance with intellectual property rights, image rights, the right to privacy and, more generally, all third-party rights;
  • any direct or indirect damage caused to MeilleursJobs or to a third party as a result of using the Service in breach of these Terms.

The User indemnifies MeilleursJobs against any claim, action or order resulting from a breach of their obligations, and undertakes to compensate MeilleursJobs for all costs, attorneys' fees, damages and indemnities resulting therefrom.

10. Hosting status

With respect to User Content stored or distributed via the Platform, MeilleursJobs acts as a hosting provider within the meaning of Article 6 of the LCEN. In that capacity, MeilleursJobs does not exercise any prior control over User Content and cannot be held liable for unlawful content transmitted to it, provided it acts promptly to remove that content or make access to it impossible from the moment it becomes effectively aware of it.

Any notification of unlawful content may be sent in accordance with the procedures set out in the Legal Notice.

11. Suspension and termination of the Account

11.1 Termination at the User's initiative

The User may at any time delete their Account from the settings of their personal area or by sending a request to support@meilleursjobs.com. Deletion of the Account results in termination of access to the Platform. The consequences for ongoing paid subscriptions are governed by the Sales Terms.

11.2 Suspension or termination at MeilleursJobs's initiative

MeilleursJobs reserves the right, without notice or compensation, to suspend or terminate access to the Service for any User:

  • in the event of a breach of these Terms, the Sales Terms or applicable law;
  • in the event of abusive or fraudulent use of the Platform;
  • in the event of non-payment of a subscription;
  • in the event of conduct that affects the security, integrity or reputation of the Platform or of third parties;
  • for any other legitimate reason, after prior notification of the User where the nature of the breach permits.

Suspension or termination shall not give rise to any refund, except as expressly provided for in the Sales Terms.

12. Amendment of the Terms

MeilleursJobs reserves the right to amend these Terms at any time in order to adapt them to changes in the Platform, in the legal or regulatory framework, or in its commercial practices.

The User will be informed of any substantial amendment by notification on the Platform and/or by email sent to the address associated with their Account, at least fifteen (15) days before the amendments take effect. Continued use of the Service after that date constitutes acceptance of the amended Terms.

A User who refuses the new Terms may terminate their Account in accordance with the conditions set out in Article 11.1.

MeilleursJobs undertakes to provide an initial response within a reasonable time, and at the latest within thirty (30) business days from receipt of the request.

14. Consumer mediation

In accordance with Articles L.612-1 et seq. of the French Consumer Code (Code de la consommation), a User who qualifies as a consumer may, in the event of a dispute that could not be resolved amicably, refer the matter free of charge to a consumer mediator. The contact details of the competent mediator are specified in the Sales Terms.

15. Governing law and jurisdiction

These Terms are governed by French law.

In the absence of an amicable resolution, any dispute relating to the formation, interpretation, performance or termination of these Terms shall be submitted to the jurisdiction of the French courts.

For Users who qualify as consumers, the competent courts are, at the consumer's option, either the courts of the place where they were domiciled at the time the contract was concluded or at the time the harmful event occurred, or the courts of the defendant's place.

For Users who do not qualify as consumers (professionals, employers, recruiters who have nevertheless accessed the Platform), exclusive jurisdiction is granted to the courts within the jurisdiction of Montpellier, notwithstanding multiple defendants or third-party claims, including for protective, summary or ex parte proceedings.

16. Miscellaneous provisions

Entire agreement. These Terms, together with the Sales Terms for paid services and the Privacy Policy, constitute the entire agreement between the User and MeilleursJobs relating to use of the Platform.

Partial invalidity. If one or more provisions of these Terms are declared null or unenforceable, the other provisions shall remain in full force and effect.

No waiver. The fact that MeilleursJobs does not, at a given time, rely on a provision of these Terms shall not be construed as a waiver of its right to rely on it later.

Assignment. The User may not assign, transmit or transfer the rights and obligations arising from these Terms without the prior written consent of MeilleursJobs.
